Rejected Temporary Employee Not Allowed to Return to Work
The Missouri Supreme Court has recently ruled that a contractual employee who had conflicts with company personnel cannot expect to return to work by moving to another temporary staffing agency. John Stehno was removed from the data management department of Sprint Spectrum LP after conflicts with fellow employees and later attempted to return to the same department after his contract with his staffing agency expired.
The hiring manager at Sprint Spectrum LP denied the request but Stehno was contracted to Amdocs Ltd. by Modis, Inc. when the former company required technical consultants to work on Sprint’s billing software. At that point, Amdocs placed Stehno in Sprint’s data management department again.
The data management supervisor quickly discovered the placement and asked for Stehno’s removal. When Amdocs complied, Stehno sued Sprint and Amdocs, claiming tortuous interference with a business expectancy. The court, however, found that Stehno ultimately failed to prove that he had a reasonable business expectation with Sprint. The court also noted that Sprint had justification for the request for removal.
